ตามกฎหมายแล้ว นิติบุคคล มีหน้าที่ต้องเสียภาษีเงินได้เงินนิติบุคคล (ภ.ง.ด.) ปีละ 2 ครั้ง นั่นคือ ภ.ง.ด.50 และ ภ.ง.ด.51 หลายๆ คนอาจเกิดคำถามว่า "ภ งด 50 51 ต่าง กัน อย่างไร?" วันนี้ นรินทร์ทอง จะพามาทำความรู้จัก ภ.ง.ด. ทั้ง 2 ประเภท เพื่อให้คุณสามารถยื่นภาษีได้อย่างถูกต้อง





ภ.ง.ด.50 คือ แบบฟอร์มที่ใช้สำหรับ ยื่นภาษีเงินได้นิติบุคคลปลายปี ซึ่งบริษัทหรือห้างหุ้นส่วนนิติบุคคลทุกแห่งในประเทศไทย ต้องจัดทำและยื่นต่อกรมสรรพากรเมื่อสิ้นสุดรอบบัญชีของกิจการ ซึ่งผู้ที่ต้องยื่นแบบ ภ.ง.ด.50 ได้แก่ นิติบุคคลทุกประเภท ที่จดทะเบียนในประเทศไทย ไม่ว่าจะมีรายได้หรือไม่ก็ตาม โดยมีกำหนดให้ยื่นแบบภายใน 150 วัน (นับจากวันสิ้นสุดรอบบัญชี)
วิธีการกรอกแบบ ภ.ง.ด. 50
1. เตรียมข้อมูลก่อนกรอกแบบ
2. กรอกแบบผ่านเว็บไซต์ e-Filing
3. ลงนามและแนบเอกสาร
4. ชำระภาษี (ถ้ามี)
5. กำหนดเวลายื่น ภายใน 150 วัน นับจากวันสิ้นสุดรอบบัญชี

 
ภ.ง.ด. 51 คือ แบบฟอร์มที่ใช้สำหรับ ยื่นภาษีเงินได้นิติบุคคลกลางปี ที่นิติบุคคลทุกแห่งต้องยื่นเพื่อแสดงผลประกอบการ ครึ่งปีแรก (6 เดือน) ต่อกรมสรรพากร ซึ่งถือเป็นการประเมิน "รายได้และกำไร" ของกิจการแบบประมาณการ ซึ่งผู้ที่ต้องยื่นคือ บริษัท หรือ ห้างหุ้นส่วนนิติบุคคล ที่ประกอบกิจการในประเทศไทย โดยื่นภายใน 2 เดือน นับจากวันสิ้นครึ่งรอบบัญชี
วิธีการกรอกแบบ ภ.ง.ด. 51

2. ข้อมูลทางการเงิน (ประมาณการ)
3. การคำนวณภาษี
4. การแนบเอกสาร
5. การลงนามและส่งแบบ
6. กำหนดเวลายื่น

 

• วัตถุประสงค์-ใช้ยื่นภาษีตามผลประกอบการจริงตลอดทั้งรอบบัญชี

• ช่วงเวลาที่ยื่น - รอบบัญชีเต็มปี (12 เดือน)

• ยื่นเมื่อไหร่ - ภายใน 150 วัน นับจากวันสิ้นสุดรอบบัญชี เช่น รอบ ม.ค.–ธ.ค. ต้องยื่นภายใน 30 พ.ค.

• ข้อมูลที่ใช้ - ข้อมูลทางบัญชีจริงจากงบการเงิน

• เอกสารประกอบ - งบการเงิน, รายงานผู้สอบบัญชี, รายละเอียดภาษีหัก ณ ที่จ่าย

• ผลทางกฎหมาย - ถือเป็นการยื่นภาษีที่ใช้ยืนยันรายได้จริง

 

• วัตถุประสงค์ - ใช้ยื่นภาษีจากประมาณการกำไรสุทธิในครึ่งปีแรก

• ช่วงเวลาที่ยื่น - ครึ่งปีแรกของรอบบัญชี (6 เดือน)

• ยื่นเมื่อไหร่ - ภายใน 2 เดือน หลังสิ้นครึ่งรอบบัญชี เช่น รอบ ม.ค.–ธ.ค. ต้องยื่นภายใน 31 ส.ค. ของทุกๆ ปี

• ข้อมูลที่ใช้ - รายได้-ค่าใช้จ่าย แบบประมาณการ

• เอกสารประกอบ - รายการคำนวณกำไร, รายละเอียดประมาณการ

• ผลทางกฎหมาย - ใช้ชำระภาษีล่วงหน้าเท่านั้น (แต่หากแจ้งต่ำโดยไม่มีเหตุผล มีโทษปรับ)

• สำนักงานสรรพากรพื้นที่สาขา (กรณียื่นด้วยเอกสาร) - ต้องแนบเอกสารและลงลายมือชื่อกรรมการผู้มีอำนาจ
